We included Move-In pack (driveway, letter box and cloth lines) in the initial quotation and it was $4,349 and now increased to around $6,500. We questioned the tender presenter the reason and advised due to the increase driveway area (quoted from 38m2 to 46m2) and set back (from 6m to 6.5m). $2,000 for 8 square m driveway, we thought it is too expensive and decided to remove from the tender list and the tender presenter also advised we can add as variation in the later stage if needed. We had another surprise in the tender list was 6 star (developer requirement) energy allowances ($3,750) and tender presenter advised that estimation will be done once the detail design is finished and the balance amount will be added as a post contract variation. We finished our tender appointment then ask us to pay the $1,650 deposit and to sign the tender. Straight away they asked us to sign the contract document and we are not allowed have any independent technical or contractual advice from anyone before sign the documents. Once signed the contract immediately we went to the bank to apply for the house and land loan. Our land loan is already approved and settlement in 3 week time, trying to apply the house and land loan before the land settlement. Bank lending manager advised that they will not accept any post contract variation and we need pay from our pocket if any variations from the contract and also advised to have the driveway in the contract to get through the valuation. Our house is facing northeast. We obtained independent technical advised on the energy allowance, soil test not required to estimate cost to meet 6 star rating and builder know the direction of the house and location therefore they can easily estimate the fixed cost to meet 6 stars rating of their product. I was trying to contact the contract administration on the same day evening and Monday morning and she was not available. Fortunately my call was transferred to the senior contract administrator and I have explained all the issues. She asked me to provide the bank mortgage manager detail for c Henley finance team to contact and explain the post contract variation issues. She also agreed to raise the driveway as a variation without any variation fee. We are still in the cooling off period unit Thursday 21 April 2016. We are trying to get the move-in pack variation approval as soon as possible to get the finance approved. I have requested Henley to send the scanned copy of the contract and still I haven’t received yet. It seems like Henley will not send variation documentation to sign before cooling off period and they haven’t contact my bank yet. I have few questions regarding my current situation because still I am in the cooling off period. Could you please anyone advise on below questions? • What sort of documentation Henley will provide for the contract variation? Will bank accept the variation document for loan application to increase the contract price or do I need to amend the contract (because bank will not accept any contract variation)? • What Can I do if Henley will not contact the bank before the cooling off period? If my finance not get through? • I can terminate the contract before cooling off period. Will I lose my whole deposit if terminate the contract?
