Hello all - just can't seem to stop having issues.
My problem at the moment, is that we have been handed over our house 3+ months ago. We paid for an item to externally duct our kitchen rangehood, and on handover I asked the building supervisor if the item had been completed and was told "yes".
Something just didn't sit well with me the whole time, and finally, OCD won and I went and tore the thing down....the foil flexi-duct was pushed into the ceiling/bulkhead via a slit that squashed the duct down to 1/2 size, but more importantly duct went no where. We had paid for an externally ducted rangehood that was verbally confirmed as completed, and it was handed over to us as being ducted to the kitchen bulkhead.
When I approached the builder - they did not object to a refund, and said they would organise for the electrician (and later plumber) to come and finish the install. Last contact was 2 weeks ago, and still not even an call to schedule a date for when someone will come out finish the works.
My problem - is that I don't want them to complete the works, I am not happy with the quality of some of workmanship used - I want a refund. The builder has insisted that they must complete works as per contract.
What legal rights do I have in terms of cancelling and refunding a contract item - that was not completed at house handover (I'd almost dare even say were deceived to about), if the builder insists on completing it?
