Communication with Rex has been poor. Have you been able to get in contact with him? yes I have Rex is just a middle man, transferring the developers words to the purchasers and on the other side he is a just like other sales people trying to sell for his clients. this is the developer who makes the decisions. I don't exactly who we need to submit the petition to Senate or Parliament. People did it in NSW, it can be done in VIC too. I spoke with the Vic ombudsman who couldnt help. They refered me to the Victorian Building Authority who also couldnt help. They referred me to the ACCC who i havent had the chance to call yet. We can try and take out a class action and to get compensation for time lost. Another developer offered their clients 20K+deposit to end contract. Lets see if we can do this. Greenvale Heritage Views 135Feb 19, 2017 11:05 am Hi All, what my solicitor or conveyancer does when my clients purchase a property on contract date is that they always put a caveat on the property that's what I suggest everyone does. By doing this the onus is on the builder to prove the caveat can be removed which costs time and money but also it can be used as a tool for compensation. (See your contract again) This clause should have been changed by your convencer. The developer anticipate the project cost with respect to the time and sell the lot accordingly. Max one can do is to argue for a show cause. Which developer has since the long delay because of the owner of that mansion house. Now one needs to calculate how to walk off this situation with minimum damage and maximum gain. Best solution to start is avoid long legal battles this will cost lots of money and time and lawyer are not there to help but to make money. So Negotiate and buy the land at lower than market price. This way you don't lose and have something to show for. Good luck |
