It's a waste of time asking for a credit, when it's in the wrong place. It might appear to the builder like you are just after the money. Best to get the problem fixed. Cheaper and easier now than after the painting is done. But check the plans. Perhaps if you'd picked it up before they got to plate height? Firstly in our legal system you can prove a defect but if you can't prove dollar value of loss you get nothing. Secondly, you have had ample time to view your frame but let it go and paid for your frame. Builder clearly has erred but you have let too much water flow under the bridge. The bricks, gyprock, etc... we're already complete but our builder ripped it all out and rectified it. Wow that's quite out! And amazing that they ripped it out! Our Builder agreed to move our window no charge and we are just as far along as you. And this is even more interesting when you consider that it is correct on the plan and we all missed that it would not line up properly with the kitchen cabinets. Though this is true, they took the stance that this this what we are paying them for, to build a house that serves its function but also looks good. One way or the other you should move it.
