Browse Forums Building A New House 1 Jul 22, 2008 10:03 am hi guys, i just bought a house/land package last sat, i put in a deposit $500on the land. Now i got 3 days cooling off to see the solicitor/convancer.
Today is tuesday and i havnt found solicitor/convancer yet, tomorrow will be the last day of the 3 days cooling off. Is it going to be to late to cancle the contract tomorrow? i dont know why they give 3 days only, its to short. What should i do? how does all this process work im so confuse. building a new home!! Re: Just bought a land = convancing? 2Jul 22, 2008 11:08 am I'd hate to be the bearer of bad news, but you should always consult a solictor BEFORE signing the contract (not a conveyancer... thats for when you settle...although some people do both).
The real estate agent will lead you to belive that "hey its ok, you can just cancel with 3 days". But you shouldn't listen to them. Basically you need to find a solicitor/lawyer TODAY, and if you're going to cancel your contract you need to do it by close of business tomorrow... in writing! http://www.lawyersconveyancing.com.au/ we used these people initially. I didn't like them personally, but they're quick.. and they wil point out anything drastically wrong with your contract. Of course, at this point if you don't like any clauses, you only have two options... live with it or cancel entirely. We purchased our block of land not long ago and we didn't use a solictor. Our conveyancer was very good in explaining everything to us. We had a few questions regarding some clauses in the contract but she was able to answer them with confidence, so it made us feel a little more at ease. If you feel there's too many things you're not sure about... then seek advice from a solictor. Our land settled in July and so far it has been a smooth sailing. Because some of the contract say unregisted subdivsion and it say will be title august for example, sometime it can be delayed. I got a solicitor yesterday, because i feel better going them, i like the feel of trust. He read through all about the contract, there is a few doomsaying lol. Bit scary, but he said its normal for a contract to say all that, it is very basic contract that most contract are the same.
