My invoice was crap though - I have asked accounts receivable to amend and re-issue before I make payment. They wrote original contract $0, variations $xx,xxx, claim amount $xx,xxx. I am very very much so wanting to withhold... But I really don't know! I think our stages have been substantially completed and I have read advice from another homeone member that its a no no to withhold due to contractual clauses that may allow builder to suspend works and charge interest. It's not worth the contractual grief and the inevitable fight. One thing though, if the invoice doesn't match the reality of the contract (for instance they are claiming variations when they should be claiming a building milestone), then I would call first and follow up with an email confirming that they haven't invoiced in accordance with the payment schedule in the contract, so would they please fix it up and send it to you asap so that you can pay it - you don't want to do anything outside the contract after all! Shazaw, for your specific situation, it's a relatively minor (in terms of cost and extent) defect, not really incomplete works, so I would pay them if I was in your situation. I would also write a letter/email to go with the payment confirming that it is made for that milestone on the proviso that the previously noted items are rectified as part of the works Ehhc - totally agree. Re: KDR Sekisui House - St George 619May 05, 2017 4:46 pm Just as well I went in while plumbing guys were still working at 3:00pm. quickly checked on items we requested and paid for and found the gas pipe for first floor living was missing. Asked plumber to checked back with their head office to installed gas pipe. Plumbing admin did admit that they have missed marking on the plan... now all sorted. We were lucky in that our old house was so small (86 square metres) compared to the new house, they were able to take enough readings around the old backyard house before… 8 36901 The biggest challenge will be if you take out a loan and then run out of money - you'll have an incomplete security and lenders do not like this so you can get stuck.… 2 18894 Hi, I am looking into doing a KDR in Melbourne and am contemplating using Kialla Homes.
