Re: Interested to Know How People Dealt With Their Contracts 2Dec 11, 2015 8:57 pm 1st-timers Did you take it to a lawyer, sign it there and then, take it home for a few days or even just a few hours? We signed it in the office. We were discouraged from taking it home to look over (they sent us a sample contract to look over beforehand). We did call our mortgage broker though to go over a few things when we were left alone to sign stuff. There's no way we would have signed on the spot!!! Ours got us to sign in the office and we couldn't take it home? It's hard to read it properly when your rep is sitting there waiting also not to mention it was done right before we went in for our Prestart meeting. Our build thread: https://forum.homeone.com.au/viewtopic.php?f=31&t=70984 Interested to Know How People Dealt With Their Contracts 6Dec 14, 2015 4:19 am Our builder dropped it around to our home with no pressure to sign it. We reviewed it and then sent it to our lawyer just to confirm there was nothing of concern, it was a standard Master builder contract. Lawyer gave us some good fatherly advice about obtaining finance and making sure the bank physically checks each stage etc and reminded us to ensure all variations are costed and in writing before they occur. Didn't change for his advice. After a couple of weeks, we were delayed due to having a baby in between lol, the builder checked back with us. They came over and we signed it. Out of principle I never sign anything significant on the spot. I was confident to go with our builder because he never tried to do an obvious sales pitch, he just told us how he would go about building the house and what options he recommended for roofing and some other solutions and fixtures. I took that to mean he knew another job would come in its place if he didn't get ours. Ours at least left the room to let us read/sign in peace. I made it clear we were not going to be pressured into signing on the spot and that we would be reading the whole thing while she sat there unless we had the documents sent beforehand (worded very nicely of course). Re: Interested to Know How People Dealt With Their Contracts 9Dec 14, 2015 8:37 am I had our contract and spec for 6 months in that time I went over it many times made changes picked up mistakes and builder had no issues with me doing that her would rather we both be on same page and avoid issues during the build. This method worked really well. You don't even have to be that nice. Nor rude. It's a large undertaking and no one should expect you to sign it without adequate time for consideration. Good luck! We've since been told that they only prepare 2 days in advance and its not possible. Instead we were sent a blank standard hia contract as that's the one they use. - otherwise known as Kym - Re: Interested to Know How People Dealt With Their Contracts 12Dec 17, 2015 10:26 pm They ended up by emailing us everything which was great. So much nicer to be able to read at our leisure and also to make a list of questions that we can take to the meeting tommorrow. Re: Interested to Know How People Dealt With Their Contracts 13Dec 18, 2015 12:04 am wow - we were sat in the office - read and signed then and there. My god if I knew then what I knew now. When we happy with it, we rang the office to arrange the date for the contract to be signed. Re: Interested to Know How People Dealt With Their Contracts 16Dec 18, 2015 2:07 am We got 5 quotes and then narrowed it down to the two builders we liked best. This didn't necessarily mean cheapest mind you. My wife then wrote down what each was willing to give and we compared and then told each of them if they wanted our business this is the deal. They both gave us everything we wanted but in the end we chose the builder we liked best. We took around 4 months before we signed and were happy with everything. Our builder is fantastic and I honestly cannot fault them. The best part is he is actually paying for independent inspections of my house. Could not believe it. My god if I knew then what I knew now. Boy would things be different. I feel as if sometimes that builders will take advantage of people. I hope everything works out for you and you have a beautifully built home. I just would have run for the hills if someone put that much pressure on me. We had the contracts for like 2 weeks going over them. Make lists and ask questions about everything. If a builder is not willing to be accommodating now, then you will be up sheet creek when the house is being built and something goes wrong. We not only have a SS but a planning supervisor too. He takes us out to site before lights, bathroom recesses, shelves, hell just about everything before it is done just to make sure we are happy with where it is placed before it is installed. Obviously there isn't much we can do with the block work Re: Interested to Know How People Dealt With Their Contracts 20Dec 18, 2015 7:32 pm We were mailed out the contract and associated drawings / details and reviewed them over a few days with some clarifications made. No pressure from the builder at anytime. That was the second contract we had received, the first builder didn't want to make changes to mistakes and close enough was good enough as things can be changed at prestart, we sat on it for weeks and after many emails and phone calss asking us to sign etc we walked away from that builder. Glad that we did. MBA and HIA both have sub contract agreements, check them out 2 7315 Industry type domestic contracts are prepared by industry bodies for the benefit of the builders.
