This was an interesting case because he had independent inspectors during the build (some are talked about on this forum) and whilst they did pick up lots of mainly smaller issues big ones got away and my client ended up with two storey french inspired lemon. There had been prior substanital claim and insurer payout before I got involved but the payout was to insurers builder whose price was wonderfully inflated and work that was carried out decidedly underwhelming.(never trust insurer's builder) It was also interesting because no one picked up that builder departed from plans and wonderful french features were omitted or mutated presumably for cost saving. Builder long into bankruptcy, I came and prepared reports with costing that predictably exceeded amount available to be claimed by a wide margin. This means that even to the max, my client could never be fully compensated. I was grateful for the thanks and the opportunity to assist the best I could. I feel sorry for anyone who has their dream home ruined. It is a shame that some of these undesirable builders aren't held to the same account as say myself as a health professional. The anxiety, depression and family issues that can result from such a building experience can really impact on a person. Hopefully these people have not been too affected. I think the relevant authorities should hang their heads in shame and the builder should have his name added to the "never to hold a builders licence again " list especially after going bankrupt ( probably to avoid having to pay up presumably ). It is really bad, over the last decade i have seen many people financially crippled and emotionally wrecked and know that at least one of my clients died from dispute-induced stress. Just yesterday I did a pre final inspection on a big two storey home and basically I had no significant issues. I did not do pre contract, pre slab and pre plaster, no one did. I call it dumb luck and there is plenty of it, but the trick is that no one knows who will get it and who won't a bit like Russian Roulette. Care to play it with your life investment? However it would be far more effective to have system of on the spot hefty fines for breaches. A hit to the pocket is the most effective way to get attention and cure errant ways.
