Last weekend my partner and I went to have a look at our house and noticed that we have two taps (one normal and one recycled) and two meters attached to each tap right in the middle of our proposed driveway. Unfortunately we do have an odd shaped block and our crossover is in a terrible spot, but we were informed by our builder that if we got a crossover extension then it wouldn't be a problem. We did get approval for this extension and the builder drew up the plans and everything was approved by the council etc and we thought that was that. I have contacted our builder and they have stated that they had no idea on where the meter would be placed and that I should contact the water company as it was their decision. Later on they have also suggested I speak to the land developers to see if they will rectify it as the design of the crossover and water meter are not appropriate for the block. After speaking with the water company I was told by two different people that they had received the building plans from the builder and they had deemed that the meters were in a good spot, so therefore it must be fine. I spoke to another person and they said that our builder hired a company that requested a document called 'Size, Depth and Offset Information', which states where the water meter is going to be installed so that they did know this information when planning the build. He also mentioned that they had someone go out to my block to take photos and he agreed that he wouldn't be happy with where they are and would make it extremely difficult to get into the driveway. I have called the VBA and they have said that I should get a quote from a plumber and if the costs are very high then I should consider taking them to VCAT to recover costs, otherwise if it doesn't cost much I should just cop it on the chin to make it easier on myself. I also called the Energy and Water ombudsman and they have raised it further with the water company. I was still told it was not their problem, but they would waiver the cost to plug the mains so that I could hire a plumber to retap the lines and re-install the meters in a new position. I have told my building admin to let me speak to her manager as I think she has gone as far as she can with "helping" me, but he is away until next Wednesday. So I am in limbo until then. The way I see it is that I'm paying the builders lots of money to provide me with a house that I can live in, which includes being able to use the garage. They have a responsibility to let me know of anything that will affect the access of the house. I agree that the developer has a terrible design of the block and they are probably at fault also as the layout is not practical at all. I'm in desperate need of advice as I am constanly going around in circles and getting nowhere. Do I have any rights??? Is this something someone else (builder, water company, land developer) should be fixing? Or is this my problem to deal with? I think the builder should be able to get it fixed for even if its not really. Just jump up and down a bit. I’m not a structural engineer but I’m free. you still need an engineer for the plans.
