The whole building process has been a bit overwhelming, but i am currently a bit concerned due to the fact we began our whole building process in February (builders and land deposits etc) and titles were due August, were delayed until October, and as of yesterday are now delayed until April or May 16. We currently live in a share house as we were planning just to jump from this house to our own, but I'm feeling a bit unsure about our rights and if there is anythinf we can do about this titles issue. I just want to start building the house. We've already done the prestart and everything else possible so we can jump right into building after settlement, but it seems settlement just keeps being moved further and further away. Any advice for a newbie to this forum as well as a fho? Re: Intro and Title Delays 2Sep 10, 2015 8:09 am Hi Mrsupton15, Unfortunately, probably nothing you can do. The land contracts are generally worded in favour of the developer. We bought our land in September 2013 with a settlement date of May 2014. We still haven't settled, 2 years later, though expecting to in the next month as we are just waiting on Land Vic to release the Titles, all of the other stuff is all done. Your land contract would have a 'sunset' clause advising the builder has X amount of months to register the land, once this expires you could request the contact be cancelled if you like. Ours took an additional 2 months to register from the developers time frame. We have done contract reviews for some clients where 6 months on they are still waiting. On the "upside" (if there is one), utilize this time to get all your plans/colours/contracts in order/reviewed so as when the land is titled... away you go with no delays. We find most clients get so focused on the land being released that the home/builder seems to take a backseat. We find this a perfect time to conduct our contract reviews where time is not a restriction. Happy building!
