Basically Land Tax is paid by people holding huge amount of lands and the value of the lands exceeds the threshold set by the OSR. Usually Single home owners are not affected but multiple property owners will normally exceed the threshold. In case of developers, they will always exceed threshold as they are holding land for development. If you contract has a clause on land tax, then you are subject to pay land tax during the settlement. You are paying the land tax because, the developer needs to pay the land tax for the year for holding that land but since the contract has the clause, the land tax will be passed over to you. Any one had this sort of discussion with the solicitor or did your contract have this clause ? For example: If the OSR access the value for your lot (example: 100 Sqm) to be 100,000 then the calculation is 100000X 1.6% = 1600 If the land is settling in March, then you pay for April to Dec and Jan to Mar is paid the developer.
