Browse Forums Building A New House 1 Jul 29, 2015 3:35 pm Although this topic was discussed on here way back in 2011 I thought I would bring it up again. Does anyone have this once settlement on your land is through and before builders are on site? We asked our builder and he said he had heard whispers in the past that some people do carry this. Although the gates are still locked its very easy to just walk around the side into the development and I do know that people walk their dogs there (although they shouldn't). Our particular block has quite a drop at the back onto the block behind us and although it has banners across, I doubt these would be visible at night. All it would take is some kid on a bmx thinking they could do 'jumps' then come a cropper. Re: Public Liability Insurance On Vacant Land 2Aug 01, 2015 12:08 am I did some research on this a couple of months back and found there is a 'vacant land' insurance that provides you public liability cover. Google 'landcover'. It's a once-off cost so we ended up purchasing it as they also had a demolition option and I found so many people wandering around our property whilst it was under demo (past the temp fencing!). Re: Public Liability Insurance On Vacant Land 3Aug 05, 2015 2:39 pm Hi 1st Timers, I think you only need to take reasonable precautions... and no pools deeper than 225mm water level at any time. But , hey have you asked a solicitor. Maybe you will be wasting your money. The fence sounds like enough to me, Cheers Leonardo_23 Re: Public Liability Insurance On Vacant Land 4Aug 14, 2015 1:26 am I'm going to be taking out cover with Landcover. Just want to be safe rather than sorry. Also a turd of a kid has been riding his bike on the blocks in the estate where I'm building. I've seen him there a few times and even though I was parked out front of my block and looking right at it he still kept riding his bike up and down where my retaining wall will be built. Re: Public Liability Insurance On Vacant Land 5Aug 14, 2015 1:59 pm We took it out as we have 9 large trees and after some storms we were worried if one of them fell on any of the houses being built next door. It was only a couple of hundred dollars for the year for us. Re: Public Liability Insurance On Vacant Land 6Aug 14, 2015 3:10 pm south australian Occupiers Liability from the civil liability act might shed some light on whethe ryou should or shouldnt take out insurance - http://www.austlii.edu.au/au/legis/sa/c ... 1/s20.html however - (6) An occupier owes no duty of care to a trespasser unless— (a) the presence of trespassers on the premises, and their consequent exposure to danger, were reasonably foreseeable; and (b) the nature or extent of the danger was such that measures which were not in fact taken should have been taken for their protection. if interpretation is similar in all states in, then your self::bbcode_second_pass_code_cb It could be argued that a) the exposure to danger, especially at night, was reasonably forseeable and that b) if other measures could have been taken to prevent the accident at night that were not taken, you could be found negligent. the existance of your post highlighting your example could also go a long way to proving negligence if in fact somone on a BMX goes to do that jump in the night and hurts themselves. The vacanty land insurance is cheap. probably unlikley you will need to call on it, but if you have an inkling that something could happen, I would recommend a) not publishing your concerns and b) taking out the insurance. Because if you do a) without b) and a) happens, you could definately be in trouble. Even with b) youd have to still take the necessary precautions to avoid the insurer seeking the costs from you.
