Not sure if this has been covered before, but I’ve done a quick search and couldn’t find anything (maybe I didn’t look hard enough). My question is who is responsible to submit a Design Approval Application Form, us or the chosen builder? My concern is that we have found the house we would like to build and have arranged a meeting with the builder to discussion options etc, but in our Land - Contract of Sale it states that “Stockland reserve the right to refuse a design that, in their opinion, is of poor quality and will adversely impact on the neighbourhood character, even though it may comply with all of the building controls”. I don’t want to go through the whole process and find out half way that the house is not “allowed”. So do we submit a Design Approval Application Form with the developers before we talk with the builder? So do we submit a Design Approval Application Form with the developers before we talk with the builder? It is the builders job to go to the estate and council to make sure they get approvals. However, the best thing to do is go to your prospective builder and ask them if they see any problems with building your desired design in that particular estate. They should know which designs are/are not allowed. Do they have a display home there? If your building with a big builder, they will generally know the rules of the estates.. we had a bit of a prob with our plans, cos stockland didnt approve, mainly cos they said our alfresco wasnt within the building envelope, but PD said that stocklands contract wasnt clear...anyway, long story short, stockland gave in when we put up a fight..... would suggest talking to the builder and make sure u read the contracts properly in terms of the estate guildlines..... hoep that helped! Our land is in Highlands (Craigieburn), and we are looking to build with PD. They have a display on that estate of the house we want, so i think i'll pay them a visit and just ask them as you have suggested.
