We took the risk of going with one of the smaller builders as he promised us to deliver in 16 weeks time. The build started 01-Oct-2014 and we were in the lockup stage by 15-Nov-2014. After that it has been a terrible experience. He hasn't completed the build yet. We have paid him 90% of the building cost (through bank). He is yet to put appliances, air conditioning unit, rain water tank, hot water unit, driveway, landscaping and some painting is remaining. Now he is promising to complete the house from inside in 2 weeks time, and he says he will issue the occupancy certificate once the bank pays him remaining 10%, which is fair. But as per my contract he is supposed to do driveway and landscaping which he says will do later. I spoke to my bank and they said they can release the money only after everything is completed as per the contract. My builder will further delay the work if I say the bank cannot pay him unless he completes everything as per the contract. I'm also in a situation where I have to vacate my existing home (I'm renting it) as the tenancy had ended 3 months back and I have been served termination notice. Also financially it is hurting me because I have to pay rent as well as mortgage. If somebody has gone through such situation, can you advise me what could be done? It sounds like your builder is trying to bluff you into paying him for incomplete work and your solicitor needs to have a good look at your contract to see where you stand. You need to be clear on the legal situation It sounds as though your builder has got financial problems so you need to be prepared for possible bankrupcy.
