Browse Forums Building A New House 1 Jun 03, 2022 7:55 am Typical case of old builder not doing anything, we cancelled the contract by sending a lawyer notice, and going through the useless DBDRV process. We engaged a new builder, and are in the Permit stage. The builder called yesterday stating that they can't take VMIA DBI insurance as the old one taken by the old builder is still active. I tried calling the old builder, who ghosts me. Any idea what can be done please? I tried calling VMIA, who asked me to reach out to the DBI Agent for policy transfer. And the DBI Agent is very hard to contact. I left an email to the agent, but any inputs on how long it would take etc., would be much appreciated. Thank you. Its a simple transfer but it appears the previous builder has no interest in sending an email to the insurers. The funny thing is there's only one insurer, they can step in if they wish to? Try the insurance ombudsman? I can see you are quite active in these forums and a reply from someone like you is a hope that there is some solution for things such as these. For non-builders like me this process is quite daunting honestly Now to the good news, I just got off the phone with VMIA. Their support team is super good. She called me first thing in the morning and told me the process to fix this. The new builder will just have to click on "Continue to proceed" button when they get the error "An insurance already exists", when applying for VMIA insurance for the property. This will initiate a request to VMIA to review and validate the new Builder credentials. They take about 1 to 2 days to confirm that the new builder can take the insurance on the property. Apparently, without this step, in the past they ended up with multiple insurances on the same property leading to a nightmare situation of who is responsible for the claim and proving it legally. I, at least, don't have to 'plead' the old builder to cancel the insurance. You have a lovely day. Regards. Unfortunately there is limited solutions when the contracts are one sided, battlers are treated like mushrooms , kept in the dark and fed bulls!t and regulators and polies are weak, etc,etc You need to enter into the next agreement with your eyes wide open.
