All in all , has the problems been fixed i have been promised it will . Do i want to move in as soon as possible , yes sure i want to . Time is a healer so what you are feeling during the beginning of the phase soon normalizes when you see the finished product , that i am hoping for . Our ss has been great and has pulled down ceilings and replaced everything. Re: Building with Metricon 8397Mar 22, 2019 1:45 pm I had to use a lawyer to assist in dealing with Metricon last year when I identified multiple serious defects in their work about 2/3 of the way through the build. The benefit was making sure the correct dispute process was followed as per the building contract. The lawyer was also valuable in dealing with Metricons misrepresentations, bluffs, false assurances of rectification and other unconsionable tactics to try to get me to accept defective works. According to our lawyer Metricons standard contract is very one sided and provides little real protection to the customer and I was bound to the accept the unrealistic liquidated damages amount of $30 in the contract I had signed in 2016. In hindsight I should have sought proper legal advice before signing Metricons contract to understand my exposure and risk. Consumers should be wary that Metricons glossy sales and marketing representations of quality assurance and a timely build are not supported by provisions in their standard building contract. Nor are they supported by their high volume and low quality business model. Maybe years ago when government regulation of building standards was more effective a weaker contract would have been ok? As a consequence of their contract you have limited practical and cost effective legal options in any dispute and will become reliant upon Metricons goodwill, which sadly many times has not been demonstrated. Re: Building with Metricon 8398Mar 24, 2019 10:20 am Our build time with Metricon was 85 weeks for a Liberty 45 in Sydney. The contract time was 42 weeks however this was meaningless because the liquidated damages for delays clause in the contract was only $150 per week. Our actual costs of the Metricon delay's was $1,500 a week in rent, storage and interest. The reason for the delay was Metricon's tactic of slowing down to pressure customers to accept their poor quality workmanship. We did not accept the defects so they delayed our build. If you are about to sign a contract with Metricon I suggest asking them why they state a 42 weeks (or similar) build time in the contract but they are not prepared to back this up with realistic liquidated damages $ amount if the build is delayed due to your inspector finding major defects like we did. Given the generally low standard of Metricon's contractors workmanship their minimal human resources to supervise your build (ie 20 houses allocated to one Site Supervisor) major defects are very likely. The contractors don't expect their work to be checked by Metricon and will do the minimum job appropriate for what Metricon is paying them. Everyone does whatever and just hopes that you won't find defects until later when its someone else's problem! Metricon's liquidated damages payment of $150 per week is a token amount and nothing compared to your real costs of delays. This clause in Metricon's contract puts their customers at a significant disadvantage if their building inspectors identify defective works early on or mid way through the build and request that it is fixed before the next progress payment invoice is sent. Metricon's low cost / low quality business model and their construction process does not support doing things properly first time, or fast rectification of defects. Its not their problem they just keep moving foward. If you find defects later its probably too late. You cannot afford $1,500 a week and just need to move in. You are over it.
