Browse Forums Building A New House 1 Jun 03, 2015 5:03 pm Hi there guys, I have created my own thread about my terrible story about my house, its finally finished and we got the keys today.. woohoo! However, we have been bumping into a wall for the last 3 weeks regarding our fencing... Our neighbours behind us have decided that they wanted to put some pavers over the boundary line, which now the fencers cannot put the fence in. Silly thing is, the contractors putting the fence in have been out to the neighbours a times to ask them to remove the paving.. However, they are being stubborn and just flat out refusing to remove the pavers... When my partner and/or myself have been over and knocked on their door, they turn the lights off and pretend to not be home (though its quite obvious they are, plus I have no idea how they even know what I look like lol) I have been contemplating just taking the damn things out, but I don't really want to be faced with either violence or court case with the issue. Anyone got any ideas what to do? I've contacted our land developer, which they have said they can't do too much about it. Which then put me on to the local council, who have said its more a civil matter... Running around in circles! I live in WA, in The Vale in Aveley. (City of Swan is my council) Speaking with the builder today at handover, he simply advised to maybe just write a letter advising them that we are taking out the pavers ourselves and give them a 10 working day lead time to do whatever they need to do, however I think that may be faced with violence as well. With the amount of contact the contractors have had with the owners, do you think it would be sufficient to just go ahead and remove the paving, or would you think a notice in the mail would be best? Fencing?? 4Jun 03, 2015 5:53 pm If a branch hangs over your property from a neighbour's tree, you can cut it off and can throw it over the neighbour's fence whose tree it is. I would be sending them a formal registered letter and asking them to remove the offending pavers within a reasonable time. Then if that doesn't work, I would be getting out the crow bar and removing them and placing them on their property. Re: House finished - Keys today but.... Be mindful that they contractors have been in contact with them for the last 2 weeks, with the owners telling the contractors that "they are finding out information from the builder". Fencing?? 8Jun 03, 2015 9:39 pm I'm from WA and have been through a similar issue, if you follow the format of the letter above - deliver through registered post and give them 21 days then the law is on your side. My neighbour responded 5pm 21 days after our letter but agreed to pay in the end as next step was the court. The law is on your side! They can't just take your land. They have until then to give me a call or email me (I gave them both my email and phone number) I stated that if they do not contact me I will remove the pavers myself, otherwise we can settle it in court.
