Browse Forums Building A New House 1 Jun 03, 2015 4:13 pm Hi Guys, I'm new here, so sorry if I've posted in the wrong spot or anything. I'm after some advice and hoping someone has been in the same situation. Our new house is pretty close to being finished, so we're looking at fencing our property to ensure our dog can't get out when we move in. Unfortunately the neighbours behind us have only just started building as their land settled a lot later than ours. They have contacted us saying they don't want to build the fence yet as they're still building and the heavy machinery could cause damage to the fence (after the slab was poured at our place I don't think I saw any heavy machinery used, but that's neither here nor there!). Obviously we don't want to wait another 6 months for their house to be built as well, and we simply can't leave our energetic Kelpie in the house while we're at work, so I really just need the answers to this question: - If any damages are made to the fence during the building process who is liable to pay fully for the repairs? I'm assuming it's the builders, but I'd like to know before I reply to them. Any suggestions or stories of past experiences would be great! Thanks Re: Building a Permanent Fence with Neighbours Still Buildin 3Jun 03, 2015 4:57 pm ill be in the same boat, not quite as severe as you in terms of house finished v slab, but ill be the first finished before the houses either side or behind, so would like to hear any pros/cons people can throw out! Re: Building a Permanent Fence with Neighbours Still Buildin 4Jun 03, 2015 5:38 pm Ive read that both in NSW and WA, both parties are responsible for paying for repairs, unless stated otherwise by the court or by the party willing to pay for the whole fence repair Re: Building a Permanent Fence with Neighbours Still Buildin 9Jun 03, 2015 9:43 pm You'll probably find in most builders documents that you sign it says stuff about retaining walls and fences etc saying if they damage it there not liable to fix it. it depends on the natural ground level, if they excavated their boundary wall needed to be built as a retaining wall.
