I terminated my builder at so called "lockup". long story short we paid lock up after pressure from the builder and promises. We got a lawyer identified the defects and terminated him. He is not insolvent, dead or disappeared so warranty insurance will not kick in to fix the defects or finish the build. He is broke but not insolvent so going to court is no option as there is no money to get back and he is hard to locate but not disappeared. So here i sit with half finished unit (VIC) Defects really aren't that bad and can be easily fixed actually. I am chasing compliance for the frame, plumbers, electrician etc..... but as he didn't pay them they wont provide the sign off. he has no money so they wont get paid...(advice on what to do here, as i'm not paying his bills) Getting a new builder to finish the job. this is where it is getting sticky. I get builders over to quote the job, most don't call back. One has started questioning taking over someone else s work and the implications to their insurance ETC. They have suggested owner builder but my loan and permit needs to be changed and to be honest I don't want to be owner builder. I just want a builder to enter a new domestic building contract and finish the job. Any major changes to the permit means huge changes with the bank and possible loss of finance. So can any one out there provide advice on where to find builders that are willing to complete a half built house, any success stories as encouragement as my head is about to pop off with stress and I feel two steps forward one back. Also can anyone explain the insurance and what happens if a builder takes on the job half way through and implications to there insurance and then next few years. Can I separate what the old builder did and the new builders work with insurance policies? Really appreciate any good advice out there as all the legal and govt avenues have failed us and we keep getting passed around and no-one providing advice to us on what to do or where to look for builders that take on this type of work or give a clear understanding about the insurance.
