Browse Forums Building A New House 1 Jun 26, 2008 7:42 pm Hi everyone, Hubby and I drove past our block today (gyprocking almost complete) and have noticed that the neighbours building materials have been delivered and appear to be for a two story home (which explains the small slab...) I have no problem with the neighbours building a two story home but am wondering what building regulations their builder has to comply with, and were we entitled to any notice, as their house was possibly in council before ours??? I'm not 100% on this so happy to stand corrected if I am way off. My understanding is that they only have to comply with rescode if there has been a certificate of occupancy issued for the neighbouring (your) block. As from the sound of things you are still building, they had no obligation to do anything. I'm in Vic so don't know if this applies to SA. Not sure about the building regulations, but you should be able to get that information from your council. As far as getting notice, where we are council send letters to all the neighbouring land owners to inform them that their neighbours have applied for a DA. We neighbour our block and so consequently have received notifications of our own development!! So if you owned the land at the time of their DA one would think you should have received notification...but as joles said not sure how it is in SA.
