Firstly, I would like to say how informative this forum has been for me! I've posted SO ( ) many questions/thread, I'm feeling abit bad that I'm constantly asking everyone everything. We are thinking of maybe taking a M3tricon house design and getting it built by a company called Redline Construction. Has anyone ever heard of them or have used them? Many thanks. Yes thats what i thought also when my partner suggested it. But his mate is doing the same thing with the builder. Apparently if you change 10% of the design, then it's legit? Yeah that's it. The climate has changed a little since that court decision. I'd be treading really carefully. You only haave to have one person work on your house that realises and you're potentially screwed. I'd be changing the plan and the facade a fair bit to be safe. The builder whose plan we wanted to build had decided ( at the time) not to build here. We were devastated. Took the plan to another builder and they wouldn't do the 10% thing because that isn't really ok anymore. Was it ever?? Hmm have to say we did it last time but that was 19 yrs ago. So asked our new builder about doing it this time. Their answer was no way. Our new builder required us to pick one of their designs instead. We then modified it heavily to suit us. It's now halfway + towards what the other design was. But you can still easily see what plan it was based on from our current builder.
Legally , if the original builder does not build in your area you can buy the plan from them and take it to another builder to build. I can't remember the cost now but we did ask at the time. I seem to remember though it would only have been feasible if we'd been owner building or going with a small private builder not another project builder. Something we didn't want to do only having just moved to the area and not having any local contacts or knowing any local builders. Re: Redline Construction. I thought it quite strange that you only need to alter 10% to get away with it. 10% isnt lot of change. Now i'm thinking twice about taking the plans to another builder. Legally, yes you can license or purchase a set of plans from a builder - but only if they say yes. I asked a builder in Newcastle if I could pay to use their plans to build a house in Melbourne and they said no. If you decide to go ahead and do it anyway, then you are playing with fire and if M'con finds out they have every right to (and probably will) sue you - worst case scenario is they tell you to pull the house down. Duminda - it's the intellectual property as a whole that is copyright - which means the plan (which includes layout, ideas, facades etc) - not just the piece of paper. If I write a song, the song itself belongs to me and is protected by copyright law - if I write it down on a piece of paper who cares - the song isn't the piece of paper, it's the melody and tune and words that I have created in conjunction with each other that make up the song and that I have the rights to. After 2 false starts, a year living overseas, two more world trips and 3 years of uncertainty we are now starting the build process again - hopefully for real this time! Re: Redline Construction.
