Browse Forums Building A New House 1 Apr 12, 2015 2:10 pm Hi Everyone. we are about to get pegged out and drove past our block to find the builder next door has dumped rubbish out the front on our vacant lot. Its rubbish that someone has obviously doiked over their fence as its not construction material. I know for a fact it came from their property as just last week we took photos of the neighbours house and can see the rubbish clearly in the photo you can also see the bobcat tyre marks where the idiot has come out of the site and dumped it on ours. Just wondering what our rights are and if eden brae would charge now to remove it. I Plan on calling the builder and asking them to take it back I can see them not complying though which will result in me then taking it to council which I still probably will not get very far with. One other thing I have noticed is they dont have a sign out the front stating who the builder is ( I worked this out anyway though ) no sign stating their PCA. The site fence is never locked allowing anyone to enter the site and is always littered with longnecks its quite disgusting. Is it illegal to drink alcahol on site I though with workcover and all that these days the amount of bottles onsite these guys would have to be well and truly tanked everyday its pretty disgraceful. I was happy to mind my own business but now that they have illegally dumped rubbish on our block if they don't remove I plan on becoming a very annoying pain in their arse what other things could I check to make sure they are complying. I endured 6 builders dumping rubbish on my vacant blog at various times. Once I had my two long fences up, I bought a temporary fence a chain padlocked the front together with an appropriate sign. This stopped my dumping problem. Approach the builder first. Constantly take pictures at every stage of build which include neighbouring property yards. Pictures can form evidence which can be emailed to the builder. If the builder fails to act, approach the owner with photographic evidence. I visited one of my neighbours on Christmas Day which worked with great effect! If the rubbish is on bordering on the nature strip, the council can get involved. Hope this helps a tricky problem. Re: Builder next door dumping rubbish help 7Apr 13, 2015 3:33 pm I can understand where you are coming from as I had a vacant lot next to mine and the builder (Broadway Homes) constantly had the sand dumped on the rear alleyway (it was a cottage block). So the sand got deposited onto my rear garden beds constantly. Furthermore, it was a double storey build which had full rendering. The builder did not bother to put up any safety net to prevent the cement from spilling onto my property. The end result was I had a couple of cement spilled over onto my plants, pavers, roof, gutter, etc. The council is of no use as they would advise you to contact the builder. I contacted the building supervisor and he told me that he would fix it once all the rendering had been completed. When the rendering was completed, he sent over a guy to fix it up. He came in and told me that the pavers had to be replaced as he cant remove the cement completely. When I went back to advise Broadway, the supervisor had been retrenched and the construction manager said he was not going to do anything about it. My options were to go to court which is a time consuming and expensive process or leave it as it is (which I did). Our builder refused to start the earthwork until the other builder removed all the rubbish and sand pile on our block. Now, we have a slab. when we checked it out last weekend, there were tire marks all over on our slab and numerous small pile of sand and rocks. We couldn't track down which builder this time. But I suspect is the same one as they started another house right next to us. This really annoys me but it doesn't seem like our builder can do anything to prevent this from happening again. What is even cheeky is that the person who did this also compact the sand between our boundary wall and slab. Good luck. Not sure what can be done. We don't have a solution either! Hence, we are likely to just pay for the builder (or a third party) to fix it rather than risk the build being delayed which we try to resolve the matter with the builder. I also had another builder, building opposite to my rear driveway that piled sand covering half the alleyway. When I complained about the sand being blown onto my garage and rear garden, he advised that there is no evidence that the sand came from the pile which he had put in as there were other construction going on in the street as well. The cost of dumping the waste in capital cities is SO expensive. You have photos, I'd shame the person into doing the right thing. I'm not a fan of going to council as they won't react unless they can issue a fine. Re: Builder next door dumping rubbish help 11Apr 15, 2015 9:23 am Hi All, Thanks so much for all your reples, we ended up going back to our block of land the sameday and picking all the rubbish up and putting back in their bin we also rang our land sales office/developer and told them the situation etc they said it has been happening alot in the area and they agreed with us throwing it back into their bin. The builder contacted us and the office staff apologized and said it won't happen again, well let's see when we go back out there again tomorrow.
