Exactly... you are entitled to get a home as good as the example of workmanship that you have been shown (i.e. the display homes). I have used this entitlement in my own build experience. If someone can remember exactly which legal document this comes from please let us know. A small update- We had our 2nd Final Inspection today. I wish I could say I was pleased. Most of the items I had a problem with had been tended to. Some where fixed, some had attempted to be fixed- and I dont think they are capable of fixing to my standards- and some of the items where left and they insisted this is as good as it is going to get. For example, the shower niche tiles. Ill attach photos in the next post. THe ones in my house are terrible. I drove all day to other display homes to try compare, and found that Henley dont actually display houses with niches. I wonder if this is the reason why... I did find 3 Porter Davis houses with niches and WOW! A was very impressed with the quality, especially after being shown what i will soon be receiving in my new home. I was also a little jealous at how the display homes where finished. The quality of the painting and caulking was no comparison for what I had been shown at my final inspection. An example of this is in the sink photos. At my inspection some other items came up. Some of these include the chipped Alfresco door they had replaced with a scratched one. Another alfresco door fell off the rail when I opened it and the range hood was noisy when turned on. There where also other small things which were done really crappy but I have come to the realisation that I will need to fix them myself after settlement. Whats that saying? If you done something right....... Im waiting to hear back from them about the niche. Has anyone here got photos of theirs that I could use as comparison? I dont like being told that it is how it is because that's how the tiler did the job. I think there is a lack of workmanship, particularly in this area. I just wanted to give people an insight of how my build progresses and to remind you to keep an eye on yours. For example, we paid extra for the NBN provision. Telstra comes out to install phone line. Can't run it through the conduit on the ground which I was assured was OK even after specifically asking. Had to dig it up myself to fix. Whilst fixing it the tech tells me they have not ran the correct underground conduit for NBN. We get the line connected but there is no dial tone in any of the outlets. Tech tells something is not right and has to leave. I call builders to fix and they send a young bloke. He changes a wall outlet connector and says "all fixed". I asked if he could test to confirm and he tells me he doesn't have a tester. Few shocked comments from me and he assures me " it will be right". Organised for Telstra to come me back out to finish the job....Still no dial tone. Tells me the wiring is incorrect. I call builder again to fix. They come out the next day to fix again. They end up installing a missing outlet in the garage..... In the end I got a dial tone for the phone but still do not have correct provisions for the NBN which cost me $700... Also IMHO, you have given them ample opportunity to fix various problems on more than one occasion, so the way I see it, the next logical step is to go over their head to enforce rectification to Standards by using the relevant state authority. I'm so sorry to see what you are going through. It scares me how many other people they try this on, and what they manage to get away with. The house down the road from me was built by the same company. In frame stage I could see into the kitchen area and noticed they did the same thing as mine before I picked them up on it. No lintels across bulk heads and they tied these framed bulk heads to the truss which is a big no no.... Pics should still be in here or on the link I have provided a few posts back. Don't assume anything and always double check things are done to standards. Even if that means bugging your independent inspector or downloading the standards yourself. I've also noticed they dont like to put many promises in writing. I know you have the house now but I would have been taking it further let alone the trades be bad but how bad is the site supervisor and quality control? The only place where it didn't help was when the standards were met but the quality if workmanship was rubbish. My inspector came about 4-5 times -Frame stage, pre plaster, lockup, final and a reinspection at the end to check that those final inspection things were fixed. How are things with the house now? Hopefully they fixed the NBN/dial tone issue..? I'm not sure if price has anything to do with it at all, but I paid $1395/sqM for 27sq home (250.838sqM), and have still had more faults than I have cared to deal with...the last being a mains water leak under my slab - but the problem was that when I discovered it I was literally shouted at for being 'on the construction site' because I took a photo to send through to the builder. No construction fence up, & no-one there to stop the river of water gushing from the underside of the slab & running down the road, so I took a pic & turned off the mains. Eventually had to resort to some curt & sharp yelling myself before the issue itself was even attended to It's been resolved now (as far as I can tell without another inspection), but why many builders continue to practice this way is beyond me. They also had to pull a string through the internal conduit for the optic cable to be pulled through at a later date. Although when doing this I lost my dial tone which I had briefly. Yes it is a shame that the standards do not enforce workmanship. I'm have strong feelings that these standards favour the builder more than the owner. For example, I had a wall which had tiles along the base. This wall was meant to be straight but had a slight curve in it. With the tiling, it looked ridiculous but my inspector said unfortunately it was within its allowable tolerance... So, from what I've experienced, builders manipulate the standards' content to excuse their poor workmanship - and they continue to get away with it because it's the workmanship that is not being scrutinised or controlled.
