It is a HIA contract and I was wondering if anyone has come across an issue regarding payment stages. The contract states that progress payments are not conditional to site inspections. Our concern (after having a crappy build previously) is that we may find an issue with a stage and want it rectified before we make payment for the next one. It seems a bit insane that stage progressions are not agreed upon by both parties before proceeding. Any advice on this? The HIA contract is written for the benefit of the builder not the mutual benefit of both the builder and owner. The government needs to mandate a uniform building contract that has equal protection for both parties. Good luck hoping your builder is a little more cooperative than ours. In saying that we are not very good at negotiating so we didnt push it. He thinks we are too demanding. I think he's in over his head or he's not getting the profit he wants because we wanted to bring in our own tiles and some other items. He kept on saying 'if you want to leave, we can stop' through the process. So now it's back to step one. Wasted 7 months on two builders now. I think you are right, there is not enough consumer protection for the home owner but you have to look at it from the other side as well. If there was a consumer trigger to stop the job for defects then every building job in the state would be on stop. I think there should be a payment stop button but only for serious defects and only triggered off by independent referee. Too demanding is him meaning we didn't want to use his tile suppliers and wanted to bring in our own fixtures for the bathroom. Probably a good thing in the end. Just hate wasting so much time. We really want to move. We hopefully have another builder lined up who the neighbours used (and were happy with). Just need to get the CAD file from the old builder. But this isn't our first rodeo so we have a decent idea what to look for.
