Building a new home with project home builder in NSW.
There has been many issues during the bus and the contract end date plus EOT's passed last month so already in liquidated damages territory.
Did a walk through with builder and highlighted items needing attention. They have a handover date of 2 weeks from walk through. Accordingly, we gave notice on our reanalysed accomodation and arranged removalists and the jbtsallation of our carpets etc for te day after the scheduled handover.
Then 1 day before the handover the builder advises that they need more time. They have not indicated how much time. We need to arrange short term accomodation rearrange carpets etc and arrange for storage of our possessions.
Te costs of which far exceed the low liquidated damages of 70 per working day.
If a builder reneges on a handover date as described above leaay they are responsible for the consequential costs incurred?
Please help.
