My dilema at the moment is our builder issued a final progress payment invoice to the lending authority and then after the Practical Completion walk though with a Building Inspector decided to issue an "Extras to Tender Invoice". The majority of the invoice was for a modification to a common driveway that was required by council prior to their approval of the plans. We were not made aware of this requirement until about 3 weeks ago and no variation to building contract was issues by the builder. Sitting here it's looking like sour grapes on the behalf of the builder as there have been previous issues with verbal abuse for having the hide to "waste money" getting an independent building inspector. Does anyone have any thoughts whether I could reject this invoice and have any legal grounds in doing so ??
