Does that apply to all easements regardless of the nature? The reason I'm asking is because the easement on our block is for eaves overhang and maintenance access not for sewerage or electrical line or anything like that. It was put there so that our neighbor can build right up to the boundary and have access. We would actually prefer for the builder to do more cut and fill instead of having a split level house. However if numerous builders are telling you the same thing, Id believe them.. It does depend on the reason that the easement exists. It is more of a legal question. Also, excavating into an easement is not usually an option but one can cut alongside the easement. It will be a lot cheaper than what the builders are charging! We are levelling out our site by ourselves (hubby is a plumber and has the contacts for us to do it cheap) for our builders (plantation) to save us roughly $3k but we have less than 500 mm fall. Also in regards to easements, yes it is true that you can't cut and fill them. It is very dangerous and could stuff up your whole site if for instance they cut into a sewerage line or the electrical line. Good luck!
