How can they claim to provide fixed price contracts with this clause? It is contradictory.

Hi Dougang. No the plans have not gone to council yet. The only thing mentioned specifically in the paperwork that prevents a fixed price contract is the lack of a traffic management plan. However, we know that there are potential issues under the soil in terms of an underground stream or body of water that was discovered when the surveys were done. It says that a variation to the contract will be required if the builder needs to make adjustments due to the water below the surface.
I guess I am confused by the terminology of a fixed price contract. It really isn't, is it?
Agree. It's fixed subject to x, y, and z. we did a knock down rebuild and our site costs were subject to change following another soil test after the house was demolished. Would have been up the creek if they found a tonne of rock under there or something similar. And by that point the house was gone!
