They are so wrong and arrogant about it. They need to provide proof of invoice. This is why they never amended it back when it all happened because they think people will forget about it and they score the money. Have they given you a reason as to why they don't owe it to you??? They claim it was an allowance and that we used 45m2 of the 55m2 so we aren’t owed anything but we would have paid a variation of the allowance went over 55m2. We have an email saying a slight credit or charge may happen if we don’t use the 55m2 or go over but now they won’t stand by that. I love when builders try and write their own rules... There will be a section in your building contract that covers allowances and provisional cost / prime cost items. If challenged, they will need to provide proof of the cost being charged and show exactly what their margin is, this is a legal requirement under the building contract. They cannot legally "pocket the difference". Try again with a formal email request for credit, pointing out the exact references to the signed building contract and they numbers involved if you know them, and offer them a period of two weeks to respond. If they fail, provide the same info to fair trading and they will get your money back without a problem. I have found a sample of a QLD HIA Contract online and can point you to clause 21.7 and 21.9 regarding providing evidence and price adjustment. Hope this helps and good luck. Yes pretty much all that you said plus porch roof still not on and balcony blastrade tombe completed and back out door areas still not 100% it's just so frustrating I thought for once we could believe them but yet once again something must have gone wrong. We are disputing whose fault going over the start date is. we made a variation to our floor plan the day we signed the contract and were told this would take 1-2 weeks to receive. We didn’t receive this until more than 2 months after signing our contract. This ended up being 1-2 weeks prior to our start date. Our bank also would not release any funds (initial deposit) to Coral until they had received the variation as it made a significant change to the build price and would need their team to verify changes. Anyway the initial deposit was made once we received the variation. We are now being told by Coral that because this payment was late that is why we aren’t on site. Even though they took over 2 months to finalise our floor plans which we would have needed to complete colours, tiles, electrical, covenant and council approval. So with the 1-2 weeks left over there is no way we would have have made it to site on the proposed start date. Just so frustrated with how slow their admin process has been. If so was this what you were charged?[/quote]We had a giant battle with them about it because our sales consultant knew our situation before we signed our contract, we left without signing it because we didnt want to commit to a start date. He then talked us into signing it and said that if we went over the date, hed make sure we got looked after and even said that coral arent they type of company to throw the contract back in your face. When it came time for him to "look after us," he didnt help at all and flat out ignored us. I was ropable over it. The only thing we worked out with them in the end was to have our fees reduced from $340 per week to $750 per month. He told us that the variation would take 2 weeks at the most to complete and therefore we signed the contract. Sometimes easements are unused and 24cm is not all that much. Good luck.
