Thanks for the advice guys! Great to hear. Well done! Hahah victory to the little guy! Hi MichaelandKaty, Ryalls_first_build, We have found ourselves in the same situation regarding contract time extensions with our house build. Our contractual completion date was 25th July 2016, and as we had to build our retaining walls in the beginning (back in March).. and the wall was built by end of April. They are requesting an extension from mid March til Mid May (2 months). Just a quick explanation as to why it took so long, it was because Coral Homes Office Admin girls made a complete mess of our Retaining wall design (plans) and removed the rear wall without getting this approved by CDC Certifier. This caused us to have to have the whole thing redrawn, re-approved. They messed it up a 2nd time so we had to wait another almost 2 weeks to correct more mistakes. We built the wall with poor weather in 3 weeks total, but 5 weeks was then screwing us around hence the 2 months it took.!!! We received 4 extension e-mails from our ss, but we haven't received any of the extensions within the 10 days time frame via formal variation to contract. We just wanted to ask you guys, when you got your extensions removed because you didnt receive the written notice within 10 days, do you know what is the "Definition" of written notice? Is e-mail from ss count for this or does it have to be a formal Post Contract Extension of time Variation letter? Many thanks, Bearof4
Ours were by letter from head office. Emailed pdf version followed by hard copy in mail. Not sure about what the actual rules are. Maybe your conveyancer can help? Re: Coral Homes general build thread 5529Sep 27, 2016 7:44 am MrsJM Question- today I told my SS I expected my island bench (3m) to not have a join and it's become apparent that even though a slab is 306cm, that they expect there will be a join. One of the issues mentioned was the weight of the slab for transportation. I would have expected that if a slab is 3.06m and my bench is 3m, 6cm is enough to play with for a mitred edge, and transportation costs aren't my problem. Has anyone had a bench this size installed without a join? C U S T O M. C O R A L. B R O N T E. 43 https://forum.homeone.com.au/viewtopic.php?t=79581 Hey MrsJM We have the same understanding. That is the only reason we ordered the 3 metre bench. We were told it was the maximum we could have without a join. The 'servery' side (cooktop/window) will have a join so that is why we decided to go for a freestanding unit so the bench would come up to the sides. I will be super p****d if it has a join. Many thanks, Bearof4
Usually if a contract or other document doesn't define a particular term, the term is defined by its ordinary meaning. I suspect from a legal perspective, the term 'written' in this day and age would generally be accepted to include email, given that it includes fax already anyway. I imagine that so long as the notification is sent via email and provides everything required by Clause 13 of the contract (extension of time) then this would be accepted as written notification. If it was simply an email to tell you to expect another notice, for example in the mail, then no- they will not have complied with the HIA contract Two months is a long extension for them to not pay liquidated damages that you're entitled to b M Y C U S T O M C O R A L B R O N T E 43 ...............Kitchen! 16 Nov 2016 https://forum.homeone.com.au/viewtopic.php?f=31&t=79581 Coral Homes general build thread 5531Sep 27, 2016 9:45 am teganandjosh PCI Tomorrow : Tuesday 27th @ 8am!! Such an exciting time Laundry, WIR and Pantry fitouts 5532Sep 27, 2016 7:42 pm Don't see a lot of discussion about Coral Homes standard fit-out for Laundry WIR and Pantry. What do you get as standard and what are people finding they have to add or modify? Most laundry's don't seem to have a bench on the plan. Is their benches or just shelves in the walk-in pantry. WIR - again shelves, hanging, drawer ??? Any insights would be appreciated. Im pretty sure the laundries come just with the sink and cupboard that holds it, we upgraded to a bench and overhead cupboards. I know the walk in robe for the noosa comes with just a shelf and hanging rail.. we had ours removed to do our fit out after handover. _________________________ Building the Noosa 26 with Coral Homes https://forum.homeone.com.au/viewtopic.php?f=31&t=80794 Re: Coral Homes general build thread 5535Sep 27, 2016 7:47 pm mpricecs Can anyone that has visited the display home share any pictures? Sometimes easements are unused and 24cm is not all that much. Good luck.
