Browse Forums Building A New House 1 Nov 24, 2014 1:24 am Hey everyone, We are currently in the process of building a house and waiting for council approval. A week ago we went to see our land and have seen that a different builder has put up a fence and poster up on our land. We were completely shocked and went through the map to make sure that it is our land and yes, it is our land! So we contacted our builder (Friday) and they have contacted other builder to remove the fence. They responded saying they will get everything removed by Monday because their fencing company was confused. So we thought it will be removed. We didn't have the time to go and check during the week so went on the weekend (yesterday) and we see that the land seems cleaner and everything is still there. They did not remove anything! This made us very angry. I have emailed our builder again to ask them to remove this by Tuesday. We did try to contact that builder but they were hopeless. They said they don't even have a record of any client building there! It is terrible! We are going overseas this Saturday and need this to be completely removed before we go. Is there anything else we could do? Call council and complain? Or what else please advise? Re: Another builder on our land 6Nov 24, 2014 10:34 am We had an issue recently with the neighbours builder placing their scaffolding on our land, right in the way of where our concreting was going to go. We did speak to the police (just out of interest, when the neighbours builder seemed less than anxious to rectify the issue). My husband asked whether if they didn’t remove it by a certain time he could advertise it (gumtree/local paper etc) to be collected and if that was legal. The officer apparently laughed and said “that IS a good idea!” but no… you can only do that if you don’t know who owns it and have already taken reasonable steps to locate the owner of the said property, ie: a sign on the dumped items advising them to move it by a stipulated time. But it seems if you know who’s it is, that’s a no-no... He said we could hire our own contractors to move the items to the land where they belong and then bill them, but there is no guarantee they’d pay and we’d have a loooong civil case on our hands. Wouldn't be worth the cost either. They ended up moving the scaffolding 3 days after we phoned (twice) but then they had a pallet of bricks and a load of timber delivered and dumped in the same spot 2 days later! We wound up hand moving the bricks off the pallet and stacking them on their side and shuffling the timber over ourselves, as our concreting needed to be started that next day. We didn’t have time to waste and waiting another 3 days was out of the question. It’s really nerve wracking when it interferes with your building. Write them a strict letter from a conveyancer or email them about trespassing on your private property. Give them 24 hours notice to remove everything off your property else you will be reporting them to the council of illegal dumping and to the police for trespassing on private property. Also include a note that they do not have any permission to enter/use your lot for any purpose in future without getting a written permission from you. Re: Another builder on our land 8Nov 24, 2014 1:16 pm I think the 'nasty' side of me would've thrown the bricks over their side of the fence, and if they broke, then let them worry about it. With these tiny blocks these days, you really can not afford the builder from the block next door fill your block with their building material. Another sne aky way is to tell a friend that you have all these 'free' building materials on your site, and they're welcome to remove them at no cost. ... bwahahahahahaahaha !!! We contacted them today and sent email saying if it's not remove by Wednesday we will remove it and will not be liable for anything. They responded saying they don't have any record nor does the fencing company have a record of putting fence up on our block so I replied back with pictures. How funny! Then they called and informed us their site supervisor will visit the area today and will ensure everything is removed. So hopefully they will remove everything by today.
