Browse Forums Building A New House 1 Oct 22, 2014 7:22 pm Hi all, Maybe someone here can point me in the right direction, I've just about had enough. The question first so you don't have to read my endless complaint. What are our legal options to get our builder to hurry up with the warranty works? Key handover was over 16! months ago and no improvement in sight, still works outstanding. The details (rant warning). We built in Perth with Redink and moved into our new house late May 2013 at which point a number of items from the handover still needed doing. Redink assured us that they will fix all remaining items on our list even after we've made the final payment. We then listed these again on our 6monthly warranty list which we sent to our builder last December. Currently a number of items have still not been fixed, most importantly our bathrooms need re-tiling. They discovered a problem with our tiles over 5 months ago. The tiles were then removed over 5 weeks ago, however not a single time is back on the wall yet. We've had enough and would like to take steps to ensurethis drama is over very soon. My drama is on my blog . Im getting a tiler tomorrow to re grout .shxt I thought it toke long to come out .they cant just rip your tiles out and leave you no tiles. Are you ringing everyday .ask to speck to amanda . I cant say you will talk to her though . Who are you dealing with at redink ..she is a manager .its not good enough dont give up . Which doesnt make you stress any less I have cried soooo much . They did bend over backwards during my build .but they just dont have enough trades and its happening with most builders . Its not acceptable but what can you do . You can yell and scream at them but you get no where .stay calm I always have coz at the day you are with them for a long time you . They built your home . I'm dealing with Michelle from Redink, she works in the maintenance department. As I've experienced part of the problem are the sub/sub/sub/subcontractors involved. Redink use a bathroom subcontractor, they again use a tiling subcontractor, and they subcontract to tilers. So by time the information reaches up and down, it's all chinese whispers if it doesn't get lost along the way. Plus nobody has the urgency to fix a problem as the money's already been paid. Mind you, not all of them are like that, we've dealt with great subcontractors as well, they were on site the next morning. I've had a look at the website of the building commission of WA (didn't know they existed). It seems that after having given notice to the builder, I can lodge a complaint with the Building commissioner for $102. Overall it seems a lengthy process aimed at serious disputes, not so much at minor disagreements. The main difficulty is that the works are actually not disputed, Redink have confirmed that they will fix it. It's just the time frame that is disputed. And the fact that they promise dates that then nobody sticks to, and things get forgotten. While I agree that bad things can happen, situations like these really enable you to judge the professionalism and integrity of a builder. Anyway, I'll see what we'll do. Looks like we'll just have to keep calling for now. A few days ago I gave the WA Building Commission a call and explained them the problem we had with the never-ending warranty works and asked what my options were, given that the works are not disputed, only the time frames. They were very helpful and pointed me to the complaints process which can also cover time frames. You can find the details about the complaints process in the second link below. So today we've now issued our builder with a Notice of Proposed Complaint and set them a deadline by when all works must be completed. The deadline gives them plenty of time to finish it. If we are not provided with sufficient evidence that it will be met, we then have the option to submit a complaint, earliest 14 days after having sent the Notice. So let's see what happens.
