Browse Forums Building A New House 1 Aug 19, 2014 12:14 pm Hi all, I have recently been directed to this site by a colleague who has recommended it as a great source of information. I am currently building a house with a relatively large builder and I was looking for some advice. We are currently at lock up stage and the final touches are just being put in now. We have had an issue however with our builder using our unfinished house as a display model for other potential customers without asking us for our permission or even advising, we just happened to catch them in the act recently. We have reviewed our contract and whilst we are aware that we have given them access to the land there is a section which states that they have a contractual license only to complete building works. I do not believe that they were authorised to access our property for their own sales purposes. Has anybody had any experience with this? We are not happy about this and have already raised it with our builders but I was keen to hear what others thought of this. Look forward to hearing some responses. Thanks heaps! Re: Builders acess to land durong construction 3Aug 19, 2014 12:37 pm Our builder had one display home in our area when we were in initial discussions with them (which has now closed as it was a few years old) but we also went with the sales rep to walk through several homes they were building for clients at different stages of construction, eg a couple were almost completed, one was being framed, one had the painters there, etc. If other potential clients were being walked through our house on the same one-on-one basis, we wouldn't have an issue with this and I wouldn't expect them to notify us beforehand. I think I'd be a little uneasy if, on the other hand, it was being treated as an "open house" type arrangement where people were free to wander through unsupervised. I know at least one builder here recently had a client's home open as their display for a couple of hours but that was obviously a separate arrangement as it was clear that the owners had moved in. ~ Anne I used to be indecisive but now I'm not quite sure. Our problem was that they did it without notifying us and then when we were there they had the nerve to kick us out because apparently the rep didn't have the authority to allow us in, we weren't impressed that we were locked outside with strangers going through our place. We have also had some fencing material (our own project) be stolen off our property so we don't really appreciate just anybody being taken onto our property As they have acted outside of the scope of our agreement I consider this as good as trespassing. Also worth noting that there were about 6 less boxes of tiles in our garage after they left... Didn't think removing site materials would have been in a sales rep's job description...
