I was told 4-6 weeks from lodgement of Pre Examination Plan which should be no later than 17th April, they need to pull there finger out and keep us up to date with realistic answers , we all have Pre-approvals on mortgage etc and dates when we should be starting building!! In late April Mac and I will have to start paying our builder $1000 per month to extend our tender. Our builder did warn us of a case they experienced with a client in North Kellyville where the developer delayed the registration to go past the sunset date. The vendor then rescinded the contract gave the 10% deposit back to the buyer and re sold the land at a higher price. I checked with my solicitor to see if this is actually possible and he advised it was. This is really worrying that the vendor can actually get away with something like this. Re: Building in North Kellyville - Allcastle Homes 28Mar 19, 2015 3:07 pm We have been told the developer is a really good one and want's things tying up just as much as us, the developer you are talking about was a small developer who bought about 5-6 Blocks of land then got greedy.I will be happy when it all goes through, We are up for fee's if it doesn't get registered this month ![]() Re: Building in North Kellyville - Allcastle Homes 29Mar 29, 2015 2:24 am Hi Everyone, We bought the land from Zarzar in white gum place.our tender is due to expired.I asked my solicitor to chase up with developer solicitor and I was told the delay is because the Deposited plan is not released by Council, so I went to the council and the lady at the reception said the delay is from developer as they are waiting for "subdivision certificate" from developer and have not received it. The sunset date is in May and I am really worried.Spoke to Zarzar today but still noone really knows when the land is registered. I've had our solicitor chase up the developer to find out more and was given the same story as ashvan13. They are saying that they are waiting on the council to approve. My solicitor said after the council approves its still about a 4-6 week process in land title registration. It could take between 2-4 weeks from now.
