If pushed to technicalities, they will say that the setback is the distance to any part of the building at all, including gutters. However, for most applications of setback requirements, they seem happy for the eaves and gutters to be inside the setback region. So to answer the question, generally they can encroach, but it can come down to the detail of the development control plan, and the convention of the council. I dug through our contract and it specifies that eaves (among other things like pergolas and verandahs) are allowed to encroach into setbacks. Ours will be a 9ft ceiling height. I'm thinking 600mm eaves would be more suitable, but they're going to cost over 3k, so wondering whether to get them or not. I prefer the look with eaves. To add to that I just looked at our quote 450mm was $40 per meter and 600 $50 per meter. In NSW , shading of your E, N & W windows and doors is a requirement as part of obtaining a BASIC certificate for DA approval.
