We've had a DA approval for over a year now. Originally we were adding a 150sqm "extension" to the existing 60sqm dwelling and making it one. Now it seems like we may be better of redoing the original part as well. I heard that if you keep the original "footprint" of the old section, it may be possible to get this under Section 96 (2) as a modification. Anyone had experience with modifications to approved DAs and how much change is allowed?

If your patio is going to be 35 sqm then that's going to need Council Approval. The fact that they previously approved your 25sqm patio will be irelevant
