Browse Forums Building A New House 1 May 27, 2014 8:45 pm Our land developer has sent a message to our conveyancer advising that the land size needs to be amended due to council requirements. In our contract it mentions that if any "material variation" to the land due to council requirements we can cancel the contract. The variation is about 20 sqm but due to the dimensions of the land we are in fact losing 40 sqm leading to a significant loss of backyard space. The developer says that the variation is not "material" and we cannot cancel our contract. They are also offering only 1/5th of per sqm price that they are charging us as compensation of the loss of area. Can you please advise if you have gone through something like this before? How could it not be a material variation?? They are changing the terms of the contract and what has been offered (land). What if you didn't want a block that small? What if the house you want to build doesn't fit on the block? I bet they want you to sign a variation to the contract? It sounds very strange and doesn't seem right.
