Thanks once again to all of you. Michelle you have been fantastic.!!! I sent an email addressing all my concerns on 26May(Mon) I followed this up with a telephone call too. SC said she will escalate this to Sales Manager and get back to me first thing 27 May. (Tues). However up to this point there is nothing but SILENCE!!! from the builder. No reply, no nothing.!!! Stick to your guns! PD gave us prices via tender and emails before contract for certain parts of the house - mainly kitchen and laundry. When it came to Contract signing and rep came back to us from a trip to the "estimators" the apron to the kitchen Island bench had increased by almost $1500. I pulled out my email from PD with the price I had been given and they had to honour it! I went through all the prices that they had and with that we had previously been told and as I had it in writing they had to honour it. I also found out after reading through my tender and contract that they had charged me $724 in total for one set of pot drawers which cost $184!!! When I pointed this out to them, they said "oh, sorry we'll just delete the extra costs"! I would probably request a meeting and sit with someone to go through it all. We deleted items from tender and then put them back in contract and the price remained the same. Good luck! It's so nice to receive a reply straight away I fell v supported. The way my builder operates is like this 1.Take deposit for tender. ( Tender valid for 3 months) 2.Draw plans- lodge DA. 3.Once DA approval received builder to lodge CC . 4. Lastly sign contract to build and return contract with first progress payment to build. Well my tender states this: The tender price will remain fixed until the tender expiry date and the builder will be under no obligation to extend the tender due to any delays in experienced in obtaining approvals from statutory authorities. On expiry of this tender, a new tender will be prepared at current prices. In my case estimating and drafting made so many errors on the plans that new tenders have to be prepared. The delay getting out their tenders so from the first tender which I signed 7/3 a lot of time has been wasted due to their inefficiencies. I thought it was best to write an email first, and then go and see them. Will take someone with me... At least with a letter I have it in writing and I can reflect on what to say. Yes he's been away. SC had a talk with him. This is her reply:- 1.They are willing to give me the quoted price on for the gyprock cutouts.This is her reply 2.With regards to variation 10 from tender A – This was priced incorrectly, and we have since deleted this from the later tenders because of it. Unfortunately, since the pricing was done in error, we cannot provide this variation to you for this cost, as the ground floor must be increased to suit this change. Due to their errors I have had to changed my plans in three places 1. BED 1 has to loose bath and 1 metre in size due to extra costs which estimating overlooked. They also drew BED 1 wrong. So if they have to provide BED 1 they have to made downstairs bigger. 2. I have to now make the lounge smaller due to more costs. 3. Meals area has to be increased and pantry made smaller due to drawing errors. I am going to meet Manager to negotiate for the other variations: My options are 1. Can get deposit back.( then I have no house) 2. Can compromise in between. I talked with two other people who have built with them. Now they all claim its a reputed company and will build a home for me. I do like the house. At the moment I have the cards stacked against me.!!!!!!!!!!!!!!!!!!! Raz If you think you can, you can. They have admitted that they were wrong! Get your money back…..lets see that put the smile on their other side! Plenty of other builders Raz…..go find one that is more together! I really worry about what will happen when they actually start building! I'm probably in the minority here, but if I were you, I would negotiate a compromise (provided of course, I'm happy with the quality of their construction/ workmanship) ... your first priority is to build yourself the right house at the right quality and price; teaching the builder a lesson or trying to prove a point comes a distant second (or third or whatever). If you walk away now, you'll be back to square one, and you'll have to spend another 6 months (paying interest/ rent) to get back to where you are now. And the next builder you go to will probably charge you even more, because they will be quoting/ building X months later. Thank you for your post balancing the pros and cons. becos I am so close to this its hard to view it objectively and in a business like way. Its very true, there is no perfect builder and I have to go thru the whole process again. Its just that they can get away with "day light robbery" if they so choose. I bet your kids could tell him a thing or two about running his business better! I am definitely going to talk to him tomorrow but not holidng my breath for much change. I've found in my last tender they have hiked the prices up. I had reduced our garage to a single garage and also pushed it into the house and was given a very good price for my rear extensions (meals and alfresco) in lieu of the garage sticking out. and in lieu of the double garage. I have now requested the garage to be double again and it's costing $6k! Just doesn't seem right to me (especially since originally the credit we were getting for reducing the garage was only $3k), so we're thinking about going back to single because with the garage door upgrade and also parapet it's costing us $8k more to have a double, and we don't really need it, we just think it will be better for resale. I have a feeling though that they made a mistake with the low price they gave us with the extensions and probably won't go back to it. Ah well we'll see what she says. Its like they get our deposit with offering us a lower price and then wham!!! hit us later. I dont belive we need to put up with their lack of attention to detail and careless pricing. Pls cross check everything. It would be great to talk to them together ... I am going to talk to Sales Manager today. to keep up the pressure you can do so to today. Let me know the outcome. 1. Avoid variations in the contract, unless it is really necessary like when encountering rock during excavation. 2. If the bricklayer & subcontractor make a mistake and try to rectify the mistake with a variation, you don't have to pay the rectification extra costs (make sure this is clearly stated in the contract). He shouldn't be changing any price. The contract is an agreement which the builder has to stick to. If you don't understand some parts of the contract bring it to a solicitor. Whatever you do, NEVER pay in advance for anything. Pay in stages when the particular job is completed (this should be written in the contract, if it's not there, get it put in). The department of fair trading (nsw) say they will help if you have a problem. I asked them (before I decided to become an owner builder). What do I do if a builder starts doing something wrong. They said "contact us and we will try to help you". I don't know if they can, but you can try.
