Browse Forums Building A New House 1 May 23, 2008 10:43 am Hi All,
Does anyone who has built with M3tricon know if they have HIA contracts or MBAV contracts? Which type of contract is in plain English (therefore i am hoping not too hard to read), is it the MBAV one? Thanks Re: M3tricon - HIA or MBAV Contracts? 2May 23, 2008 4:16 pm First phone call from my CSR, he said it is an HIA contract.
Does anyone know if it is written in plain english? English that i would easily be able to read and understand or is it full of legal terminologies in which case we need to get a sollicitor to have a look at it? Re: M3tricon - HIA or MBAV Contracts? 3May 23, 2008 4:22 pm It claims to be plain english.....it isnt too bad.
Maybe you could ask for a blank copy from Met3icon - we got one from PD before we went to sign the full one - its just a "fill in the blanks" standard contract. Built Porter Davis "Dromana" 2007. Hi Vanderlay, Did you have to get a sollicitor to have a look at it before you signed? Or was it simple enough for you to read through it yourself? Our CSR said he would send us a blank copy, that will be useful. Thanks Re: M3tricon - HIA or MBAV Contracts? 5May 23, 2008 4:30 pm We just looked at it all ourself. They stuff they fill in is really just name, address, prices, dates,etc...you'll probably spend more time going through your plans/specs/tender (these form part of the contract) etc to make sure that all are correct than the hia contract itself! You can pick up a copy for about $26 from some bookshops (eg. Home Ideas Centre bookshop).
It is heavily biased towards the builder, which you would expect since HIA members are bulders (that is, HIA is financed by builders for builders). Demolition August 2009, Construction Started September 2009, Completed December 2010 Re: M3tricon - HIA or MBAV Contracts? 7May 23, 2008 4:30 pm It is a fairly plain HIA contract until you hit the specifics. thats where you need to make sure that all your infomration is 100% correct.
Oh and check to make sure they get your name right..... Cheers Re: M3tricon - HIA or MBAV Contracts? 12Jun 07, 2008 9:18 pm Just my opinion - if you're signing a contract for something that is going to cost you $200k-$300k - regardless of whether its in 'plain english' or otherwise - i would seek legal advice. An hour of a solicitors time to not only read over the contract and draw to our attention any issues an to clarify your understanding of what is being agreed to would seem to be money well spent. Bear in mind that certain 'plain english' terms have settled 'legal' meanings - the benefit of form contracts is that all of the terms have been argued in court and so have established meanings and effects - however if you don't know what those settled meanings are then it might as well be written in arabic... MBA and HIA both have sub contract agreements, check them out 2 7315 Industry type domestic contracts are prepared by industry bodies for the benefit of the builders.
