It looks like we have a fight on our hands with our neighbours. OUr builder has scheduled our build to start in 2 weeks time, but due to the retaining wall collapse, the site is too dangerous. I'm under the impression that if the build is held up in any way by us, then we need to pay the builders additional fees? Does anyone know? If we end up in court with this issue, it could take months. The other "worst case scenario" is that after all this is done, we won't be able to afford to build the house as planned. We have demolished our home, so are renting, which we budgeted 12months for - this could blow out. So what sort of fines would we have to pay if we end up pulling the pin on the build altogether? My mind is racing through worst case options at the moment. I was really hoping this would be able to be sorted out amicably with our neighbours, but it doesn't seem to be going that way. So, any ideas of fines to the builder if we cannot start building for months, or if we cancel the contract altogether, and have to redesign a smaller, cheaper house down the track? Or maybe we just sell the block as is, and strt again...... Seems like they would be the best ones to ask about whether there are additional fees for a delay. Ours is something like 0.5% of the contract for each month that goes over. Have you obtained legal advice about the retaining wall issue? Try not to worry too much about the worst case scenarios, the process is rarely smooth for anyone. I assume with your builder you would probably just lose all the deposits you have paid if you pulled the pin.
