Browse Forums Building A New House Re: Plumbing inspection failed 61Apr 01, 2014 4:05 pm New updates: After I sought legal advise and informed the builder of this and that the works they want carried our is after effects of what the plumber should have done. They have started to write me emails about their beautiful clauses in the contract and how I am obliged to sign off on the variation. As per Clause 11, we notify you of the extra work required to comply with clause 11.1 by email from myself on Friday 28th. We have not ordered an extra inspection as you state below and are awaiting the signed variation as per Clause 11.2 from yourself before proceeding. Furthermore, the owner has the responsibility as per Clause 11.3: the owner must sign all documents and do all acts as requested by the builder to obtain all permissions, consents and approvals required from the relevant statutory or other authority. As stated in my previous email, if the variation is not signed and completed, we cannot comply with the plumbing codes and therefore cannot complete handover. Why not just get rid of the hose completely, put a standard fitting, get it signed off and then replace it after handover? I wouldn't be arguing with these building company's you will get nowhere. Can you discuss with the builder the option of removing the hoses? Lastly, how badly do you want handover to happen? I have spoken to every body possible but it takes time to resolve disputes and I am not sure what the builder can do legally via the contract. I.e. can they pass on the council fine for failure to resolve the valve issue. I want hand over asap hence I am thinking of giving the builder options of resolving the issue my way. Don't know if that will work but might be worth testing. The hose is needed for the hand held shower head. I prefer to keep it. Re: Plumbing inspection failed 67Apr 03, 2014 9:09 pm After many email correspondence I still had to pay a negotited amount to get the issue resolves but reserved my rights to go to QCAT as my solicitor told us that the builder should not and is not a variation. The builder stuffed up and should have fixed it at their own costs....hand over is next week. Had a look at the house to see if they fixed up some of minor defects outside....and they haven't. As per my first post; the builder's plumber did not comply with the plumbing code when he fitted the Flexispray. It does not matter who supplied it. It should not have been fitted without a non return valve. The builder did not notify you of the non compliance issue after the first inspection, thereby denying you the opportunity to offer a resolution. It was the builder's decision to not address the Flexispray's non compliant issue prior to the second inspection and the builder's responsibility that he re-presented a non compliance issue for a second inspection without attempting to address the issue. That is exactly what my solicitor said and extremely disappointed that a builder did this knowingly. I would love to give them my feedback at hand over.
