Browse Forums Building A New House 1 Mar 20, 2014 7:31 pm Is there anyone out there that is currently building with Onley Living by Design formally Onley Constructions. I would like to know how many people are out there who have not had their buildings completed. I am in the final stage and have had only 1 trade work on my building since October 2013. My home was to be completed in Dec 2013. We also paid for Fix Stage once inspecting the house this stage was not finished and yes they scamed us out of a payment for work incomplete, and yes then conveniently went into administration (voluntary). I agree Onley should be ashamed of themselves, but I do not only blame them I also blame the Administrators for allowing them to continue trading under Onley Constructions. If they had not allowed this company to trade and put them in liquidation my building would be complete as I would have been able to put in a insurance claim. The insurance company has advised they do not pay for builders not completing the work by contract date. I have contacted Administrator and have been advised that they have not received any complaints about Onley since November regarding houses not being completed. This is why I am writing this letter so I can forward these numbers to the Administrator and Consumer Affairs - I also wonder why no one has gone to A Current Affair regarding this mans arrogant behaviour, business practices and misery he has caused us all. Paying for uncompleted work was a mistake on your part and I doubt if you have any recourse. I am not saying that the above is right but that is the way it is unfortunately, videlicet poor house warranty insurance schemes in many States that fail to protect the buyer. It is a disgrace. The customer can't buy it themselves even if they want to. Seriously - I'm in Qld - the guy across the street's builder went broke - the insurance people appointed a new builder and the house was finished with all the usual warranties. Albeit 2 -3 months late. The difference is your neighbours builder went bankrupt. Onley aren't bankrupt (liquidation) and therefore you can't claim on insurance. Onley are still in business but dragging their feet completing the house. Only when Onley are in liquidation can the home owner claim for insurance. That is what the OP is angry about. It seemed to me they were saying the company was unable to continue - thus bringing the insurance clauses into play. BUT - I am not across Vic law. Most of the time the customer is not out of pocket (as long as they don't pay process payments for uncompleted works). The ones who really get screwed over are the tradies who not only lose out on their labour cost, but also materials.
