Last July we signed a Deed of Contract for the purchase of a block of land from a Developer ( a house and land package) One of the conditions of assignment of the land to the purchaser (us) was that we enter into a building contract with the Developers associated company (a specific builder) within 5 months of signing the Deed of Contract. That 5 months has now passed In addition to signing the Deed of Contract, we entered into a Preliminary Services Agreement (PSA) with the Builder for and paid for: The provision of one sketch plan of the proposed house before engineering is ordered Provision of Engineers soil report and construction footing report Provision of one fixed price quotation Application to council for Planning Consent We have received the sketch plan of the proposed house. Soil samples have been taken but we do not have a report and we have received one fixed price quotation. The block of land we purchased was one of several blocks (all adjoining ours) on which the Developer has subsequently commenced earth works to establish approximate slab levels. My questions are: If we have not yet signed a building contract, can we withdraw from proceeding any further with this builder? From my perspective the conditions of assignment of the land have not been met and we are legally entitled to now have a choice of builder. Would we be liable for the cost of any earthworks that have been carried out if these earthworks were not included in the PSA but completed by the Developer on the assumption that we would go ahead with the Builder? Water has been run to our block. Would we be liable for the cost of this or is part of what the Developer has to do to gain development approval?
