Our house was completed 6 months ago and the builder was sent the paperwork by council to release the 'footpath bond' (we gave the $500 to the builder for the bond) so council can repair the cracked footpath. The builder has not done that to date and council have received complaints from neighbours. Now the council and I have asked him many times and he still hasn't. I emailed him today again basically begging him to sign it, and this is his reply.... [i]....the town of Subiaco have passed the buck, each time they have spoken with me I have asked them to send me what they say is damage by us compared to what was existing damage, which they have failed to do. I have spoken with them this morning and as soon as they give me the information I have asked for I will organize to repair it myself, however making repairs to these items do not form part of the contract and will be reimbursable by you. Once I have the council requirements of what they want fixed I will organise a quote for you prior to commencing any works.[/i] Is he just stalling? Is the council required to send him evidence of the condition of the footpath prior to and after the building works. Will the council allow him to repair it himself and do we have to pay for it? And do we get our bond back? I sent him several photos of the footpath clearly showing it was in good condition in the area before and after the damaged area and said I wanted the bond back which we paid. What are my rights and what exactly is the contract between builder and council regarding footpaths normally?
