If i were the agent and they have refunded 3 of 10 clients in similar circumstances i would be treading carefully, as this is a morally and unprofessional practice. Reputation is something that cant be bought, and these days referrals work of somebody who knows somebody that knows somebody. The agent makes their cut from actual sales so it would annoy them they are wasting time, money and energy with buyers and then pi**ing them off! Hmmm......seems to be a pattern going on here..... There was land in a different stage up the road, asked if i could swap it for one there, told me i will loose my 5% deposit, but it will be fine Sunset clause was 2 years so we still had almost a year to go by then. We waited it out for 2 years, checking up on the estate every month, still the same day we bought it! Contacted the Agent about a month before the sunset clause ended asked the agent for the 5% deposit back, and she asked why, were we not happy? We were offered to swap with one of the blocks in a different stage,wouldn't lose our deposit Told her we want out money please, were done! 2 months later we put in a offer for one of the other stage blocks, we asked for a reduction of 15%. We were dealing with the same Real Estate but a different agent, didn't tell him our previous dealings. Funny enough the developer agreed and we went in to sign the contact and we saw the first agent we dealt with. She went off her head, telling us she INVESTED so much time and energy in us and couldn't believe we done this to her. My wife dragged me out of the office, i was ready to give her a piece of my mind She blatantly lyed to make a sale and instead of swapping the blocks over (still would have made her commission) decided to screw us around. We wasted 2 years beacuse of her! Oh and guess what? The original block is the same as the day we first looked at it....next month it will be 3 years to the day. Probably needs a mow by now Just to makea point about this, an approach that some people have found sucessful in negotiating these rises down, Is to provide some workings to the builder, specifying… 4 81723 Fair Trading can issue orders to rectify and complete but once the matter goes to NCAT these orders are automatically vacated.
