We are building with Eaden Brae (lot 4023) and hopefully expect to start in July/August

They are not obliged to pay half if you do it without their consent. They're obligated to share the cost as per law. They may decide not to build for years and may choose to ignore the letters, in that case we will never have an agreement or their consent. But for a house that is complete, a fence is required. You don’t need a fence up to get Occupancy Certificate. Good luck getting any money back via arbitration or legally....best to get consent or hope the neighbour will do the right thing once they start building. If you relying on getting money back....speak to owners or wait till you get in touch someday. We had a dog so needed fences, neighbouring on one side hadnt started building. They verbally agreed to pay "when they could" - 5 years later it took asking nicely (repeatedly), offering installments, taking it down the legal route, being told we were entitled to the money legally, but not having a way to get the money, and then finally they relented and gave the cash to my parents. They had been living in the house about 3.5 years by the time they paid. They are supposed to pay half the cost of the cheapest type of fence, so in theory if you wanted something fancy youd pay any extra above a regular fence.
