Browse Forums Building A New House 1 Nov 18, 2013 1:52 pm Hi there, First time post, however would like to thank everyone on this forum for their particularly helpful threads that we have read throughout our build. You have saved us many times! Our builders are now 8 weeks over our contractual practical completion dates, and we have been into liquidated damages for this period. We received a Notice of Delay letter today claiming days when adverse weather prevented works being carried out on the site. Could anyone shed some light on whether this is allowed by the builder or not? I was under the impression that once the contractual date had passed, notice of delays were a thing of the past? Whether the claim is acceptable, and thus able to reduce his liquidated damages is another issue. Contractually a claim is only valid if the delay was subject to unusual weather conditions (see http://www.anewhouse.com.au/2012/08/con ... ct-period/) but that doesn't stop plenty of builders trying it on!
