I'm really worried about this because the blocks either side of us haven't yet been sold and we have to put fencing in straight away for our dog. We wont' be able to move in unless we have fences. Hi Lucinda, Scott actually has fences both sides to his house right to the front boundary line as they had both moved in whilst all the paperwork was going through for the land purchase. The neighbour to the left has not bothered, so far, to contact Scott re payment but Scott had to approach the one on the right hand side as that is where the carport had to go, right on the boundary. He was a bit concerned but he had the encumbrances on his side as it was a condition that the build went there. The neighbour was quite good about it as long as Scott paid half of his quote then he was happy for Scott to have the fencing that was removed and he could use it for his back fence. They have a vacant block behind them and that owner has refused to do any fencing at all for the whole street. So it did all work out in the end. All they need to do now is fix the gaps where it doesn't quite meet. Lucky Scott's FIL is very handy and he is helping Scott fix it all up and put his back fence up as well. I think the neighbour on the left hand side must be happy to pay for the lot as nothing has been mentioned and I think by law time has expired for him to approach Scott. Mind you Scott was not obligated with the right hand side neighbour either to pay him but he did it to be neighbourly and he was worried that they might cause some grief. I must say we were all worried he would end up with different coloured fences on either side and knew that he couldn't do a thing about it!! But as luck had it they had the same colour monument on both sides and this was the colour he wanted!! I am not 100% sure of the process about informing potential neighbours you want half of the cost of the fencing and if they need to build on the joining boundary so maybe you need to check that out on how to go about it. I have an idea of the way it works but I don't think I know the whole process to advise you. jo they have to give scott 30 days notice prior to erecting the fence so if they have not contacted him in regards to fencing legally scott does not have to pay them unless he wants to. Re: Hickinbotham build progress so far 84Aug 23, 2013 3:24 pm What happens, though, if Scott's block was vacant when the neighbours put their fences up? Can't they go ahead and build fences and then claim when Scott owns the block? Re: Hickinbotham build progress so far 85Aug 23, 2013 3:30 pm _lucinda What happens, though, if Scott's block was vacant when the neighbours put their fences up? Can't they go ahead and build fences and then claim when Scott owns the block? i havent got a copy of the fencing act infront of me atm but i am pretty sure that it is their bad luck and scott gets a free fence. the block behind us is vacant but our sales consultant said it was on hold and he was trying to hurry them up as he obviously wanted the sale. not sure if we are going to bother or not with our back fence and getting the money for it as we already have it booked in and we havent given anybody 30 days notice(only the 2 side neighbours). Re: Hickinbotham build progress so far 86Aug 23, 2013 3:37 pm Hi Hachy and Lucinda, You are both correct but Scott didn't want to start off with a conflict or anything so he just approached the one that he was most concerned about on the right hand side due to the boundary issues and neither of the neighbours had sent notification. We are presuming the one on the left hand side isn't going to bother with payment (well he better not now lol). If you aren't coming to have a look on the weekend I can take a pic for you if you like. We had to go to the house in the dark tonight and see all the completed gyprocking. No cornices yet but not far away. It must be getting close to lock up I think. There was some strange looking pieces that was delivered today but need to see them in the daylight to make out what they are. I think 1 pack was door frames but can't be too sure. I had to wear my wellies to get in the house as the front is just a muddy mess!! It doesn't look that bad in the pics but in front of the porch it is impossible to walk there. Hopefully with the drier weather this week it should start to dry out. David and I are going away for 3 1/2 weeks in October and we have been joking that when we get back at the end of October he will have moved out into his house by then My son and his fiance's build viewtopic.php?f=31&t=66084 24/7 Slabbed 30/7 Framed 05/8 Gutters 08/8 Roof & windows 31/8 gyprock, bricks, cornice 3/9 Lock up 8/11 In Re: Hickinbotham build progress so far 95Aug 25, 2013 3:21 pm Looks fabulous, Joane, and amazingly fast! I agree, some screening plants along the fence will look beautiful from the dining and family rooms. Will be awesome to move as soon as you get back from holiday. Re: Hickinbotham build progress so far 96Aug 25, 2013 3:29 pm Thanks Lucinda. It would be nice for them to be able to move whilst we are on holidays but they will need our help more than likely once they can move in. So in a way we hope they will be a little bit longer than that.
