A full on visit....to show them in ,in presence, we are real with overwhelming issues.... Would anyone like to visit them with us? While I am all for doing something pro active I am not sure what a mob-style demonstration is going to achieve. Can I just say to anyone that is still hoping free life is going to finish your house, the chances are slim to non -existent. At this stage the best outcome will be for them to appoint an administrator and commence insolvency procedures so we can all get our insurance claims underway. Reading between the the lines of last weeks announcement - The company has been unable to find a purchaser for the company so in a last ditch attempt to make a few bucks before going under, they have sold what contracts they can to another builder. They have been unable to find a buyer for the jobs already commenced as there isn't enough profit margin and/or too much risk for another buyer to take them over. I am guessing that they are probably now seeking buyers for individual contracts as they have thus far been unsuccessful is selling them all as a bulk packet- Which is probably bad new for anyone at lock up stage, where the profit margin on remaining works is likely negligible. This is the bit that infuriates me ! There needs to be a legislative changes to empower the BC to force administration. As far as I am aware, the BC doesn't have this power current under the act they operate under. As I understand, the options are a) they appoint an administrator voluntarily or b) registered creditors get together and force administration. The problem has been, either the contractors aren't angry enough to form caucus or they are not informed enough about the process. I have run a credit watch report on capital works / freelife and there is currently only 1 registered default reported to ASIC against them for a fairly insignificant amount, which would indicate that the aggrieved creditors (assuming there is some) aren't taking any official action.... This also means that on paper, Free life have a relatively good credit score, which has allowed this sh#t to go on as long as it has. If there are creditors (unpaid contractors) monitoring this forum, take action !!! its the only way we are going to get a resolution other than voluntary administration, which free life appear to be delaying/ avoiding at all costs. This could be anywhere from $10,000 - $50,000 per house we should be entitled to lodge complains against there credit as well. I would also bet the banks would also like to enforce this as they also are an interested party. The only one that wouldn't be is the bank they actually deal with as they probably have an overdraft. I'm not sure why anyone would have paid money before the specified stage is completed (other than the deposit). If your bank has release funds for a stage without completing a progress inspection to verify completion, that's an issue with your bank... If you think you might be classified as a creditor for the purposes of the legislation, you could look into it.
