Based on the 9 news story last night and your feedback to date, I would suggest a meeting with Mark McGowan (he was on the story last night). His staff maybe able to get you some answers and he needs to raise his profile before next state election. He would want to know details, such as names, contract dates, progress date etc. might be worth organising this (not on here). Honestly people go to see politicians over very minor issues - you are entitled to do so as citizens of WA and he is involved in the other case. Email states that the BC will continue to meet with the directors of FL on a regular ongoing basis until the issue is resolved but doesn't look like there is a great deal more they can do than continue to annoy them ? My apologies for not writing to everyone individually. The Building Commission met with the directors of Capital Works Constructions on Monday. They indicated that they would be writing to their clients this week. I think that most if not all of you would have received that letter by now. It seems from that letter and from the information provided by the directors to the Building Commission that Capital Works Constructions is working on a ‘resolution’ to the issues that have so affected you as clients. Unfortunately, the company has not given any indication of what that resolution may involve or when exactly it might be implemented. Because of this, the Building Commission intends to meet the directors again mid-next week. I would expect that we would continue to meet periodically with the directors until the company’s resolution is implemented or this situation is otherwise concluded. I understand that this is an incredibly frustrating situation for all clients of Capital Works Constructions and one that has very real financial and other implications. I’m sure that you all want evidence from the company of what it’s doing and your homes completed as soon as possible. A number of clients have asked me what the Building Commission can or will do to resolve this situation. Unfortunately, this is a situation that really only Capital Works Constructions can resolve. Without speaking specifically about Capital Works Constructions, I would like to make the following general points: · If a company is experiencing financial difficulties, the normal process is for the directors of that company to place it into voluntary administration. · Alternatively, creditors of the company can take action to place it into involuntary administration. · The Building Commission does not have powers to place a company into administration. · The Building Commission can take action in the State Administrative Tribunal to cancel a builder’s registration. · That action is similar to a court proceeding – with evidence ultimately being presented at a hearing – and so can take some time. · Cancellation of builders registration is not a trigger for claiming home indemnity insurance. · A company being placed into administration or its deregistration by the Australian Securities and Investment Commission are both triggers for claiming home indemnity insurance. · While the Building Commission has powers in relation to the conduct of a building company, it does not have a role in influencing the commercial or financial decisions made by a building company. I’m sorry that I’m not able to be of more help at the moment. I will provide another update towards the end of next week. In the meantime of course, please feel free to contact me if there’s anything that you’d like to discuss or you have any questions that I haven’t answered. However, I will unfortunately be out of the office for the rest of this week, beginning this afternoon. If what the original Freelife email sent out is correct , we will hear in a few weeks. All this movement is great, I think! I'm not saying I excuse Freelife AT ALL! But this is the most movement (on site or offsite) that's happened in many many months!!! If the next piece of info from Freelife is not what I'm thinking it is ... Then I will be upset, but for now... I think we could see some movement on our houses very soon and hopefully the backlog is cleared before the end of the year! Its up to the creditors i.e. any contractors or financial institutions that they owe money to, to proceed with involuntary administration. As pointed out in the BC email, the only real course of action they can take is to deregister them as a builder which would probably be the worse case for us as the builders indemnity insurance doesn't cover this event. Basically only 2 scenarios that will assist out position: a) they get bought out/ merge/ find some money to be able to finish the jobs; or b) become insolvent and trigger insurance. FL's update would seem to indicate they have one of the scenario A solutions in the works. While the conversation started out very tense it did finish on a positive note. I intend to give Freelife 2-3 weeks time as asked by them to try and resolve the issue. What everyone needs to keep in mind that while FH going insolvent will trigger insurance the process itself is long and can be painful. At best 6-12 months before any work through insurer would commence. So faced with another long delay I am inclined to give them 2 weeks and see what sort of resolution they are hinting at. Logical thinking would imply that as soon as the media and politicians get involved any deal for FH goes out the window. In any case its a win win situation for everyone to wait a further 2 weeks. Either we win , FH gets the money it needs and work starts on our homes or they don't we go to the media, they fold, we wait 6-12 months and insurer takes over - and we get into our homes somewhere along the line. In my opinion a shorter time for completion is worth 2 weeks of sitting tight and not making waves Good luck to everyone here and let's keep our fingers crossed. Wish you all the best.
